The city council of Simferopol gained first victory over long judicial litigation with the Spiritual Management of Muslims of Crimea (SMMC) for the land on Yaltinskaya street, 22, in the capital of the peninsula. The city authorities want to break a park on the disputable place, and Muslims - to build there a mosque. About this informs Islam for all referring to New region.

The edition reminds that on February, 15, the Economic court of the ARC obliged Simferopol City Council to make the contract with the SMMC concerning the rent of the land in the size 2,7 Ha on Yaltinskaya street, 22, for construction there a cathedral mosque. Attempt of the mayoralty to appeal against this judgment in Sevastopol Appeal Economic court proved to be unsuccessful. Then the mayoralty appealed on the given decisions to the Supreme Economic court of Ukraine (SECU).

As it stated the lawyer Hatidzhe Mamutova, who represents interests of the SMMC in the given process, on Tuesday, October, 7, the SECU cancelled the previous decisions of courts which provides building of the mosque on Yaltinskaya street, 22, and sent the duty on repeated consideration in the court of the first instance. According to the lawyer, it at all does not testify about full victory of the mayoralty of Simferopol over judicial litigation as the SECU did not stop office-work, and specified to the court of the first instance, what actions it should undertake to consider the given duty in the best way.

Nevertheless, Mamutova declared, that the SMMC is going to appeal against given decision of the SECU in the Supreme Court of Ukraine. "Though I am the lawyer and I am extremely rarely use such kind of formulations, but in this case I see someone's order, someone simply needs the conflict", she said. “Therefore, I think, that we shall not agree with this decision of the court". In any case, thinks the lawyer, up to the end of the current year the given judicial litigation will not come to its end, because for consideration of the appeal in the Supreme Court or in courts of the first instance several months are needed.

The mayoralty, on the contrary, regarded the decision of the SECU as "victory of the law". However, city authorities do not hurry to start the creation of a park zone, as on the disputable land is situated the picket organized by Majlis of the Crimean-Tatars.
