The majority of cult objects of Muslims constructed in Crimea since 1991, are used by the religious organizations without certificates, have no design-budget documentation and appropriate registration of the ground areas. While the Crimean Muslims complain on obstacles from local authorities in the decision of questions of building and legal registration of mosques, officials wish to fine the organizations using objects not placed in operation.
According to the Republican Committee on Religions of Crimea, out of 80 Muslim mosques, 68 have no official commissioning, as it does not have more 27 cult buildings concerning other faiths. According to the authorities, in the absence of the design-budget documentation and commissioning certificates, visiting of some of these objects is unsafe for physical health of the Crimeans.
The majority of mosques were constructed in the 90th years at the expense of foreign sponsors. Religious communities either grasped the ground area, or built a mosque on the basis of oral arrangement with local authorities. A mosque was constructed at the expense of sponsors' means, it was photographed, and they reported on it and left. But there is no land area, no project, and it is generally neglected", the chairman of the Republican Committee on Religions of Crimea Vladimir Maliborsky says.
The 90-th passed, but also now a number of religious communities conduct building of cult objects without appropriate registration of the documentation with the "provocative", according to Maliborsky, purpose. He gave as an example a Muslim mosque around Balaklavskaya Street in Simferopol. By the way, on the territory of the Simferopol area there are about 30 non-legal cult objects. "I do not want to say that only Muslim mosques are under construction without legal documents. These facts, but in a smaller proportion, also have the Ukrainian Orthodox Church and Baptists", the chairman of the Republican Committee on Religions of Crimea says.
The penalty at the rate of 50 % of cost
As a result the authorities of Crimea decided to call infringers of the town-planning legislation to responsibility.
According to the head of the Republican Committee on Religions, the problem was recently discussed at the session of the State Architecturally-Building Control (SABC). According to its results each religious organization which uses the objects not placed in operation, were sent extracts from the law. This document establishes responsibility of the enterprises, associations, establishments and organizations for carrying out of civil work without the permission — for this is appointed the penalty at a rate of 50 % of cost of these works. The same documents were directed local authorities because "the superficial approach to building of cult buildings in Crimea threatens life and health of the Crimeans and at any moment can lead to sad consequences".
"We already had negative examples when in representation of the Pokrovsk temple in Jankoi fell the 100-ton bell, — the head of the Republican Committee on Religions says. — Fortunately, it occurred during a downpour, nobody suffered. Another example — in mosque representation in the village of Oktyabrskoe fell the industrial plate. We do not know, from what materials and how these objects were built. Therefore not honestly performed works may result at any time".
The authorities provoked illegal building of mosques
The Mufti of Muslims of Crimea Emirali Ablaev does not share alarm of the official, "The people who will pray in these mosques, will never build poorly". Certainly, it is necessary to legalize papers, and communities are engaged in it, probably, not so quickly, as it is necessary, but if to impose on them now penal sanctions, hardly probable it will accelerate the process. It will just cause the protest, he notices.
"In the beginning of the 90th I worked in Kirovsk area as the regional Imam and then the local public prosecutor declared to me that without documents the mosque will not be built, — Ablaev recollects. — I agreed: well, let's do the documents, but I got the answer that it never will happen". The official building license of a mosque was not to receive in those days, therefore they were built illegally, and after all it was necessary to begin everything with naught. So we face now a very interesting situation: at first the authorities did not allow to build a mosque, provoking believers to illegal building and now post factum officials decided to earn on it.
The Mufti of Muslims of Crimea declares, "In the beginning of the XX-th century in Crimea there were 21 thousand cult Muslim objects from which till 1944 left only 1700, and by 1987 left only 5. Who is guilty in it? Probably, the state. Therefore I do not hide that I authorize for building of mosques. Certainly, we cannot construct 21 thousand, but we will construct 1700, and the state is obliged to prepare documents for them. But obstacles from outside the authorities, as they were 20 years ago, are still present. And that the authorities say that except a cathedral mosque, neither in Simferopol, nor in any other area there are no obstacles for building of mosques, is a lie. If there are problems in my house, who is guilty in them? I am guilty. And if there are problems in Crimea, the Crimean power is guilty in them. We are ready to meet half-way, to work together".
As it was informed earlier, the adviser of the Mufti of the Spiritual Management of Muslims of Crimea on international relations, Arsen Alchikov, on July, 10, at the Commission Session at the Ministerial Council of Crimea concerning property returning to religious organizations and restoration of their rights declared on July, 10, that the Crimean Muslims face considerable difficulties at registration of legal documents on the constructed cult buildings.
"About 60 new mosques in Crimea have no commissioning certificate because no one supports us, everyone even hamper. It is just impossible for us to make everything according to the law", Alchikov commented.
