The Spiritual Management of Muslims of Crimea considers the decision of the Supreme Court of Ukraine to be made to order, by which the SMMC was denied in reviewing of the ruling of the Supreme Economic Court of Ukraine concerning the allocation of land for building the Cathedral Mosque in Simferopol. About it states the appeal of the SMMC to the public, stated Islam for all, with the reference to the "E-Crimea" agency.
As it is stated in the appeal, the Supreme Court upheld the ruling of the Supreme Economic Court, according to which a case is remanded for consideration by the Economic Court of the Autonomous Republic of Crimea. The Spiritual Management considers that this fact will cause "a new round of court hearings concerning the case of forcing the defendant – the Simferopol City Council - to conclude an agreement of the lease of the land for building" the Cathedral Mosque. In addition, the SMMC is sure that "The Trial Chamber of the Supreme Court of Ukraine did not consider the case at all, and the definition ... was signed not only without its study, but even without reading the text of the appeal".
In this connection, the Spiritual Management called the President and the General Prosecutor of Ukraine "to use the powers entrusted to them in the Constitution and laws of Ukraine and to curb overt discrimination of Muslims in Crimea - Ukrainian citizens by local authorities of Crimea, now based on the decisions of judges, judging by order, and not according to the law".
As it was reported by the"E-Crimea", the Supreme Economic Court of Ukraine on the complaint of Simferopol City Council sent the matter concerning the land area for the Cathedral Mosque to the Economic Court of Crimea.
Earlier, the Mayor of Simferopol Gennady Babenko suggested holding a city referendum on the building of the Cathedral Mosque, located on the Yaltinskaya Street, 22. The Mayor believes that the majority of citizens would speak against the building of a mosque in this place.
On July, 24, the Simferopol City Council decided on the assignment of the land area the Yaltinskaya Street, 22, the title of "Jubileyniy" Park" followed by the definition of its borders and prohibition of any construction work on the territory.
On November, 23, the representatives of the Crimean Tatar community erected a fence around the land area on Yaltinskaya Street, 22.
INFORMATION: On July, 2004, the Simferopol City Council agreed with the Spiritual Management of Muslims of Crimea upon the location of the land area of 2,7 hectares in the Yaltinskaya Street, 22, and gave out the permission to working out of engineering. On January, 10th, 2008, at the session of the Simferopol City Council it was decided to allocate the land area of 2,7 hectares for the mosque building on the Lugovaya Street, 6, instead of the area in the Yaltinskaya Street, 22. On February, 12th, the Crimean Tatars began the action on Yaltinskaya, 22, on collection of a shell rock stone for building of the Cathedral Mosque. On February, 15th, the Economic Court of the Autonomous Republic of Crimea obliged the Simferopol City Council to conclude with the SMMC the contract of rent of the land area the area of 2,7 hectares in the Yaltinskaya Street, 22, for building of the Cathedral Mosque in a ten-day term.
